Well, now you don’t have to wait to be sued to find out what can happen. IIANC recently produced a 2-hour video E&O Mock Trial which is available for CE credit through ABEN, the Agents and Brokers Education Network.
This is a “Mock” Trial in name only. We spared no effort to bring you as realistic an experience as you can have. We used a script provided by Swiss Re/Westport and secured an actual courtroom at the Wake County Courthouse. The judge in our trial served for 16 years as a judge on the NC Court of Appeals. Our defense attorney, Mike Medford, is a Raleigh attorney who also serves as Panel Counsel for Swiss Re/Westport and has defended agents in numerous actual E&O claims.
We produced this as a “bench trial”, which means that there is no jury present and the judge is the decider of the case. In fact, there were several times during the “trial” that the judge went “off-script” and was asking questions of the witnesses as well as the attorney’s. This added greatly to the realism of the trial and also offers viewers an insight into the legal aspects that are important in deciding the outcome of the trial.
